Show (c) So far as the controversy involving the mainstream is concerned, the Boulder Canyon Project Act and the Secretary of the Interior's Contracts control. Congress by the passage of the Boulder Canyon Project Act made an apportionment of the mainstream water of the Colorado River controlled by Lower Basin mainstream dams and reservoirs. (d) Of the first 7.5 million acre-feet of consumptive use available from the mainstream for the Lower Basin, the Secretary of the Interior is to apportion 4.4 million acre-feet to California, 2.8 million acre-feet to Arizona and 300,000 acre-feet to Nevada. Any surplus over the above-named amount is to be divided equally between California and Arizona. Arizona's surplus share is subject to reduction by 4% if the Secretary of the Interior shall so contract with the State of Nevada. (e) In case there should not be sufficient mainstream water available for 7.5 million acre-feet of consumptive use, the available consumptive use shall be apportioned: 2.8 Arizona California Nevada 7.5 (f) In case there is not sufficient water available to supply "present perfected rights" of a state, these rights shall be supplied first from the unused apportionment of the other two states, and if there is still a deficiency, each of the other two states shall supply such needed water from excess over their "present perfected rights" in the proportion "that its apportionment of the first 7,500,000 acre-feet of consumptive use bears to the aggregate apportionment of the two states. . . . Thus if water is to be supplied to California from the other states' apportionment, Arizona shall contribute 2.8/3.1 and Nevada .3/3.1 of the total amount supplied." If two states are deficient in supply for their "present perfected rights," the other state shall supply the same from its excess over "present perfected rights." California's "present perfected rights" shall not be greater than 4.4 million acre-feet. If there is insufficient water to supply "present perfected rights" in all three states, priority of "present perfected rights" regardless of state lines shall apply 30 7 .5 4 .4 7.5 .3 |
