Show the Southern Division, or in the alternative, of arrangements for delivery of power to customers in that Division by other means, specific assurance shall be obtained from prospective customers in the Southern Division that the principle of recapture set out above will be applicable to allotments to, and contracts for, the sale of power to such customers. "(5) Project power is not to be sold to a preference customer for sale or exchange to a nonpreference customer for resale. "(6) Delivery of power will be made at the voltage of the project transmission system, i.e., 230 and/or 138 kv, 115 kv, except that deliveries of power may be made at lower transmission voltages at those delivery points at the powerplants to customers already having a lower voltage level established for their system at the point of delivery. "(7) Delivery of power to customers be made at the identified delivery points, or at such others as may be finally established by the Secretary. All costs for delivery of power beyond such delivery points to be borne by the customers." Trcmmission Lines As of the date of this report the Secretary has not announced his policy regarding transmission lines to distribute Colorado River Storage Project power. It is expected that a decision will be made about the first of next year. B. LEGAL Arizona v. California, et. al. The Special Master appointed by the Supreme Court to take testimony in the lawsuit, Arizona v. California, et. al., submitted his draft report to all parties in May, 1960. By this procedure, an opportunity was afforded the various participants to raise objections and argue them before the Master prior to his filing the report with the Supreme Court. On December 5, 1960 the Special Master filed his report and recommended decree in the Supreme Court of the United States. The significant conclusions reached by the Special Master are: (a) So far as the issues of Arizona v. California are concerned the Colorado River Compact does not control. (b) The controversy was divided into two parts: namely, that involving the mainstream of the Colorado River and that involving the Gila River. The other tributaries in the Lower Basin were only incidently considered with respect to their water contribution to the mainstream. 29 |
