Show CALIFORNIA DEFENDANTS Exhibit No. 5621 Identification: .................... Admitted: This number is reserved (Tr. 22,531) for an exhibit which the California defendants may offer comparing the Colorado River Compact Commission's "Minutes," offered by Arizona (Ariz. Ex. Nos. 207, 208, 209, for identification), and the "Minutes" quoted in R. L. Olson, The Colorado River Compact (1926) (Ariz. Ex. No. 314, for identification). Arizona reserved Exhibit No. 314A for this purpose (Tr. 22,530), but at the date of printing this page (December 1, 1958) had not furnished a copy of Exhibit No. 314A to the California defendants. Earlier Arizona counsel had announced, on the occasion of filing Arizona's motion for leave to file amended pleadings (Calif. Ex. Nos. 7301-06, for identification) : "Mr. Wilmer: In that respect, I might say further that in the course of Arizona's rebuttal, the matter of the Colorado River minutes came up, as Your Honor recalls. We do not at this time feel it necessary to press further our motion that they be admitted in evidence. We are convinced that, while we do not desire to withdraw the offer, nonetheless we believe that in the light of our change of affirmative, formal change in position in relationship to the Gila River and the interpretation of the Compact-that is, no longer seeking to add to it or change it-that their importance in use assumes a different aspect in the case." (Tr. 20,322-23) |
