Show APPENDIX G 301 hamper its consummation and ratification {id. p. 284). But the Upper Basin Compact has now been signed and ratified by all five states, parties to it. (S. Doc. No. 8, 81st Congress, 1st Session). C. That "The allocation among the lower basin states is substantially settled by the law of the river." But the In- terior Department says that there are at least four great unsolved questions {id. p. 24), that they involve over 2,000,000 acre-feet {id. p. 26), and that "the water which Arizona projects now in existence, under construction or authorized will require when they are fully developed is much more than the supply available to that state if all of California's contentions are taken to be true," and vice versa as to the California projects "now in existence or under construction" if Arizona's contentions are taken to be true {id. p. 26). The Interior Department thus finds, not that the allocation among the lower basin states is "substantially settled," but, to the contrary {id. p. 25) that: "The bare statement of these questions, the knowl- edge that there is disagreement between Arizona and California about answers to be given them, and the fact that, if the contentions of either state are accepted in full and, if full development of the upper basin within the limits fixed by the Colorado River Compact is assumed, there is not available for use in the other state sufficient water for all the projects, federal and local, which are already in existence or authorized, would seem to indicate that there exists a justiciable controversy between the states." D. "That the adoption of the proposed development will delay the development of the river." {id. p. 283). To the contrary, the Bureau of the Budget says {id. p. 28): "There is agreement among all agencies concerned as to the urgent need for resolution of the water rights issues involved. I do not believe, however, that resolu- tion of such issues through litigation inevitably would bar further development of water resources of the Colorado River Basin during the period of such liti- gation." |
