Show 16, 1931, under first form, act of June 17, 1902 (32 Stat. 388). The Bureau of Reclamation, having made a favorable report on the application, the legend on the map has been prepared so as to modify said withdrawal in accordance with Departmental instructions of May 13, 1912. The Acting Secretary of Agriculture, in his letter to you of December 12, 1933, transmitting the application, stated in part: "The project covered by the right of way requested is being constructed under the provisions of the National Industrial Recovery Act. It traverses the Colorado River Indian Reservation for a distance of approximately five miles. Since this project is a part of the Recovery Program the Assistant Secretary of the Interior sent a telegram dated November 28, 1933, to the District Engineer of the Bureau of Public Roads at San Francisco granting permission to begin construction work on that portion through the Indian Reservation, subject to future payment of damages if any and compliance with applicable laws and regulations. Bids were opened for the work by the Bureau of Public Roads on December 5. The entire cost of construction is to be borne by the Government and the work will be supervised by the Bureau of Public Roads. It appears that the lands within the reservation traversed by the project are unallotted and, according to the Superintendent of the reservation, of little or no value to the Indians. It is believed, therefore, that the question of damages should be waived in this case."
