' result of litigation, and that this action of replevin would be tried at '' the June, 1889, term of the circuit court. He also reported that some 3,500,000 to 4,000,000 feet. of timber cut by Hynes and Crowan was ' skidded in the. woods, wncerning which no action had been taken. , . May 26,1889, report was made to the Department upon a proposition - for wmpromise submitted by W.A. Rust, esq., in behalf of Mr.Hynes, ,. , by which he agreed to pay $2 or $2.50 per thousand for the timber ? ' cut, which proposition, as stated by the AttorneyGeneral, under date of June 15,1889, has been referred to the Solicitor of the Treasury for his proper action. I have no later information upon the subject. On the Bad River Reservation no timber was cut except nuder duly , approved contracts. ~. On the Lac Court d'oreilles Reservation 1,767,070 feet, ~ d n e da t $2,798.61, was cut from patented lands, contracts for which were not ' submitted to this Office. The sum of $2,060.02 was paid to the pat- . entees, and $951.29 is still due. Fiye million six hundred and twenty- ' five thousand five hundred and seventy feet, valued at $13,716.19, was ' . also cut on nuallotted lands, which lands, however, had been selected by the Indians, and their selections recorded in the farmer's books. No , contraots for this timber were submitted to this Office. The sum of 65,947.96 has been paid to the Indians who selected the lauds, and the sum of $7,804.33 remains unpaid. The amounts unpaid on these two items were tendered by the contractors or trespassers to Special Agent ; Cfiardner, who declined to receive them. Special report was made upon the subject July 3,1889, and a supple-. ' mental report August 19,1889. The question as to whether payment shall.beaccepted for this timber so cut, or whether the parties shall be . proceeded against as trespassers,is now pending before theDepartment. \ Report was made by Special Agent Carduer, June 16, 1889, regard-ing operations on the Lac du Flambeau Reservation, from which it ap-pears that a few cases of trespass occurred, for which mttlement ha8 - not been made in full. Special report will be made in this matter as soon as the decision of the Department on the Lac Court d'oreilles cases is cominuuicated to this office. Under the date of July 24, 1889, Agent ~e&y, of the La Poiute ' , Agency, tran~mittedto this office a petition from the chiefs and priu- ' cipal men of the Bad River Indians, a;sking'permissiou to sell theirpine timber, and also apetitionof applicants for eighty-acre allotments, pray-ing that their applications be granted. Agent Leahy made the follow-ing statements in reference to these requests: , Heretoforecantraatafor thesaleof timber have been exeonted, advancea made by the Mntrsctars to the Indians, and logging operations aotnally begoo before either the al-lotment or contract had received the approval of the Indian osoe.
