'r*,4} . . wilmmmmmni _•••»» •_•• __• _• n u r n - mm • AIT ORDINANCE GRANTING HO SOUTHERN UTAH POWER COMPANY AN ELECTRIC LIGHT, HEAT AND POWER FRANCHISE AND REPEALING AN ORDINANCE GRANTING TO SOUTHERN UTAH POWER COMPANY AN ELECTRIC LIGHT. HEAT, AND POWER FRANCHISE DATED THE 23rd DAY OF MARCH, A.D., 1944. Be it ordained by the City Council of the City of Cedar City, Iron County, State of Utah, as follows, to-wit: Section 1. There is hereby granted to Southern Utah Power Company, A Utah Corporation, its successors and assigns, hereinafter called the Grantee, the right, privilege, and franchise, from the effective date of this Ordinance, to generate electricity and to construct, maintain, and operate, in the present and future streets, alleys, and public places in Cedar City, Utah, electric light and power lines together with all the necesary and desirable appurtenances, including underground conduits, poles, towers, wires, transmission lines and telephone lines for its own use, for the purpose of supplying electricity to said City, the inhabitants thereof, and persons and corporations beyond the limits thereof, for light, heat, power and other purposes. Section 2* All poles and lines hereby authorized to be erected in the streets, alleys, or public places of said Cedar Cjty shall be located in such manner as will not unnecessarily or unreasonable interfere with the ordinary and customary use of said streets, alleys, and other public places; and before locating any new or additional poles and lines hereunder, the said Grantee shall secure the approval of the City Council of said Cedar City or of some authorized officer of said City to the location proposed, and no such new or additional poles, lines, or works shall be located otherwise than in such reasonable and appropriate locations therefor as may be designated by said City Council or same authorized officer of said City. 1 |
