A- •', •'. i . . •• •>''. ••?••» '-' v- '* te- In respect to the Round Valley Indian Reservation in California, specifically referred to by you, the act of October 1, 1890 (26 Stat. ,658), provides for the survey and allotment of the agricultural lands to the Indians in severalty, for the reservation of a reasonable amount of grazing and timber lands, and for the survey of the remainder of grazing and timber lands, into tracts of 640 acres, and the sale of the same," the proceeds thereof, after paying the expenses, to be placed in the Treasury of the United States to ay. the credit of the Indians. Ay The act of February 8, 1905 (33 Stat., 706),- B directed that all the lands relinquished from the Round Valley Indian Reservation under the act of October 1, 1890, supra, should be surveyed, reappraised,: and thereafter be subject to settlement and entry under the provisions of the homestead laws of the United States, and that all the lands thus opened to settlement remaining undisposed of at the expiration of five years from the taking effect of the act might be sold and disposed of for cash, the proceeds to ben" disposed of. as provided in the act of 1890. ,;.73-n|| Under these provisions of law this reservation 3. clearly falls within the second class, and the Indians 7 are entitled to possession of the lands until the same shall have been- settled upon, entered, or sold.
