YgyA \ Sir: You have submitted the question of jurisdiction - over lands within Indian reservations after they have-been opened to settlement and entry. Aa,g 7 The question is perhaps not one so much of jur-.-A isdiction as one involving the rights of the Indians to the use and benefit of the lands after provision has been made extinguishing the Indian claim and making disposition of the lands. You note that such lands may be divided generally into two classes: (l) Those which the United States has purchased from the Indians and paid for, the Indian claim thereto being thupi, completely extinguished; and (2) those which the United States agrees to dispose of for the benefit of the Indians, without, however, becoming bound to purchase • the lands, whereby the claim of the Indians remains -.- unextinguished until the lands are finally sold. 7 .: The department agrees with you that as to the A A first class the Indians have no further concern and-'A 'A that after the cession such lands are properly underAA'-g the jurisdiction of the General Land Office. nA.YYy7:;;A - ." ..;•.• " ;••'. . -^ y *£-•'- •••:'*' XiJ '".,..'"", "'/••" . y.i.'-' • y ••' • • ..-A klhe department also agrees with you that the-Indians are-rightfully entitled to the use and benefit of.- the lands coming within the second class until they shall have been finally disposed of, with the condition, however, that the use thereof shall in nowise interfere with the speedy sale or other disposition provided by.y law. There should be no difficulty in properly hand- •- ' lihg such cases through joint cooperation between your office and the General Land Office. There can be no objection to permitting the use of such lands by the' Indians or for grazing purposes for the benefit of the Indians, provided always that such use is so controlled as-to not interfere with the settlement or sale yf-'.i|SSi :„r':':Y. •" -.: agy/ayvAnna-n--' yyy. -. • A.,*A y> • ' •>.
