Spokane and Palouse Rai1zcay.-The act of May 8,1890 [2G Stat., 102, and page 386 of this report], grnnts right of way for the extension of this road from a point on the northern boundary of the reservation on the Potlatch Creek to the Clearwater Rirer, thence following the valley of the rirer in a southeaaterlg- direction to the western boundary. It provides that no rights tliereuuder shall accrue until the cousentof the Iodiaus to the right of way, and the compensatiou to be made to them by the company, has been obtained. The Duluth and Tinnepeg Rail&cay.-The act of June 2,1890 126 Stat., 126, and page 357 of this report], grants right of way for the extension of itsroad through thereservations, and section 2 of this act provides: That it ithall be the duty of the Scorotsry of the Interior to !lx the amount of oom-pensation to be paid to the Indians for snoh right of Key, and provide the time and manner for the payment thereof, and also to ascnrtain and fix the amount to be paid to individual members of the tribe for dsrnnges sustniued by them by reason of the ooustruetion cf said road. Said oompmy is hereby sntboriaed to enter npon said reservations for :he purpose of snrveying and loosting its line of railroad: Provided, That said line of railroad shall be looated, oonstruoted, and operated with due regard to the rights of the Indians and nuder soah rules and regulations as the Secretary at' the Interior shall presoribe. Notwithsts.nding these requirements, Agent Shuler, of the White Earth Agency, reported to this office, June 23~1la st, that this company mas engaged with a large force in the work of co~~s t r t~ctai nragil way through the Indian lan(1s under his jurisdiction, and he was immediately adrised that the company was authorized only to survey and locate its line, and that all work of construction must be stopped, pending compli-ance with the conditions of the act. He mas instructed to see that the companrobserved the lam, and to remove them from the reservation as intrudera if any further illegal construction was attempted. July 12th, Hon. U. E. Daris filed in this office a copy of the articles of inwrporation of the company, its charter from the State of Minne-sota, and two maps of the deiiuite location of its proposed line.
