Show per acre from Duchesne River to 10,000 acres of Indian land in the Midview Area Instead of 3 acre-feet per acre of unregulated flow from Lake Fork. 8. Recognition of a water right for Group 3 and Group 4 land (totaling 2,595 acres and several from Duchesne River) ahead of non-Indian land. % 9. Agreement for a diversion allowance of 4.0 acre-feet per acre for all Indian lands served from the Duchesne River. 10. To improve quality of water of irrigation, the diversion points for Wissiup, Leland, and Ouray School canals would be moved upstream to the vicinity of Bridgeland. 11. Recreational opportunities for Ute Tribe in Starvation Reservoir. 12. The opportunity to develop, by exchange, more productive agricultural land, such as the Leland Bench area. This would meet the Deferral agreement concept. 8. Litigation: Two court actions have been filed against the Bonneville Unit. Civil Action No. C-74-9 (Sierra Club et al., v. Gilbert Stamm et al.,) was litigated in favor of the defendants (Stamm et al.,) by the United States District Court for the District of Utah, and the decision was upheld by the United States Court of Appeals, Tenth Circuit.
