Finally, December 7, the company replied that no opportunity had been afforded it of being heard upon the question of tbe damages, and that an award made in this way is incapable of enforcement. April 19,1902, the office was informed that the matter of the legality of the assessment of damages was under consideration by the Assistant Attorney-General for the Interior Department.
