' v4^***™ ^Terms of the agreement which follow here raise other very significant questions - whose implications may be enormous. j These terms and their implications should be carefully scrutinized and not passed over.j "if the District discharges its obligation to provide water for minimum stream flows, in whole or in part, with project water from the original 313,000 a f, the project facilities will necessarily be used to provide the water, and the costs allocated to the water will be reallocated by the U.S. in accordance with Federal Reclamation Law. In this regard it is recognized that project water developed for minimum stream flows and fisheries is nonreimbursable, and the District shall not be required to reimburse the U.S. for money expended there-fore. Beyond the acquisition of the 22,300.a f of water, (comprised of the 15,800 a f noted above and the 6,500 a f provided under the April 12, 1965 resolution), all of the parties hereto will cooperate with each other in acquiring additional water, with the goal and (J^LH^X^ intent of acquiring a minimum of 44,400 a f. (should there be restrictions on where and from whom this water is acquired? Are water rights free of stipulation? If the State DWR obtains Kennicott Copper water, will this be permanent, until 1994, free and clear, or what?V The District shall not be required to share in the cost therof. If the U.S. participates therein, it will be with non-reimburable funds.
