(Consdering the 15 year history of refusal to deal with instream flows by both the Water Conservancy District and the BuRec, the apparent lack of recognition by most elected officials in Utah of the enormous public value of unique land and water resources on the Uintas; and, considering the ultimate failure or unwillingness of the Forest Service to adequately press for its management prerogatives under existing laws it can use, leaving the option of obtaining the remaining water sources and rights thereto, up to these Agencies- State DWR, U.S.Fish & Wildlife Service and Foret Service* is untenable. Before any agreement is signed, in the interests of interagency cooperation, all participators to this agreement should have down on paper the official rights to the needed water sources. A Nature Conservancy water specialist in Denver told me the Forest Service could apply for rights to deep aquifer sources for its management purposes. Why does the F.S. not do this? The Uinta Range is pocketed with ground water - layered into the Mississi-ppian limestone beneath all the Forest lands. With future growth and development in Utah and specifically in Northeast Utah inevitable; with the use of the Uinta Range and its classified wilderness and fishery, wildlife and recreation resources becoming dominant in the management of the three National Forests on the Range, the necessity for acquiring water and establishing purposes of the reservation doctrine through existing and applicable laws, is imperative. The ommission of actual acquisition of title and sources of the 22,100 a f of water to make up the 44,4000 a f total, is unacceptable. Opportunity for public approval of this agreement which will control management of l^nr!* belonging; to the nation's public, is necessary. If the State DWR does acquire Kennicott Copper water rights, now, what does this in fact mean? The State DWR has always had to comply with State policies where developments are concerned. This Agency has no separate freedom. Does the DWR or the State then own the water rights? This should be stated in legal terms in any agreement.
