Show 28 Mexico, Colorado and Wyoming, and the users of water therein or thereunder, by way of suit, defense or otherwise, in any litigation respecting the water of the Colorado River or its tributaries. All lands in Arizona are owned and held either by the United States or by those claiming under the United States. All rights to the use of water for irrigation in Arizona are appurtenant to land, and such rights have no existence separate and apart from the land to which they are appurtenant. Consequently, the water of the Colorado River and its tributaries cannot be used for irrigation in Arizona except by those holding land under patents, grants, contracts, concessions, leases, permits or licenses from the United States or under its authority. Moreover, in order to irrigate Arizona land, it is frequently necessary to utilize rights of way over public land of the United States. Thus, under said act, all users of water for irrigation in Arizona would be subjected to the Colorado River Compact, notwithstanding said State has never ratified or approved said compact. XXVII Said act provides in section 16 thereof that any commission or commissioner duly authorized under the laws of any State ratifying the Colorado River Compact shall have the right to act in an advisory capacity to and in co-operation with the Secretary of the Interior in the exercise of any authority under the provisions of sections 4 and 5 of said act, and shall at all times have access to records of all Federal agencies empowered to act under said sections, and shall be entitled to have copies of said records on request.
