Show FEB 21 1944 p > My dear Judge Stone t This will supplement my telegram of January 6 regarding the proposed contract between the United States and the State of Arizona for the delivery of water from Lake Mead for use In Arizona. There are enclosed fifteen mimeographed copies of the oontract aa approved and executed by me on February 9. I did not approve the proposed contract until I had considered carefully the objections made by California in its brief and at the hearing before me on February 2» In this connection, for your information and for the Information of the Committee, I also am enclonin, a copy of ay memorandum of February 9 on the February 2 hearing. I wish to call your attention to two ohangea in the contract, as executed, from the draft as it appears in the transcript of the October 30, 1943 Meting of the Committee of Fourteen which yon transmitted with your letter of December 31, 1943* In Article 7(b) the opening clans* reading "In addition to the delivery of a aaxisam of 2,800,000 acre-feet provided for in subdivision (a) of this Article, subject to its availability fbr use In Arizona the provisions of the Colorado River Compact and the Boulder Canyon Project Act" has been deleted since it is surplusage. Also, to reassure California that Article 10 controls specific provision* of the oontraot in reserving all quest!ens as to the amounts of water available to Arltona, or any other state, under the Compact and Act, the words "This oontract shall not impair," appearing in the first line of Article 10, have been deleted and the vorda "Neither Article 7, nor any other provision of this oontraot, shall impair" have been substituted therefor. The Department appreciates the consideration which you and the members of the Committee of Fourteen have £iven this natter, and the cooperation which the Committee has extended to Arisona and to this Department.
