XXI These conditions were approved by the Department on March 22 Iast, and a copy thereof transmitted to the oompany for its acceptance or rejection March 31. On the 7th April last the president of the com-pany r.eplied objecting to the terms imposed by the Indians as being excrl~tiouallys evere, and not justified by t,he tenor of the act of Con-gress undcr which the eompilliy had proceeded to take the preliminary stt.l~sf or the ooustruotio~o~f the road. On the 13th April last this ofice replied that the terms lipon which the Indians eonsented to the right of way did not materially ditier from those voluntarily proposed to the 111dians by the railway company April 21, 1882, viz, the build. ing of a school-house on the reserve at a, oost of $3,000, and fencing of the road. A definite answer was requested from the oompany whether it vould acoept the conditions or not, but up to the time of closing this report no rep11 ha.s been reeeived. I understand, however, that no 'action has beeu taken by the company towards building the road npon the reserve. Sioux Reserzte in Dakota-Chicago, Milwaukee and 8ain.t Paul U l - , nay.-Since the date of my last annnal report this compa.ny has paid inte the Department, for the use of the Sioux Indians, the sum of $1,424.76 compensation for right of way and depot grounds on the Orow Creek Reserve, east of the hfissouri River, in accordance with the termsof the agreement of November 10,1880. The maps of definite location of the 640-acre tract west of the Missouri River, the 188-acre traet east of the rirer., taken by the company for depot purposes, and of the right of 1 wa.y through thtj Crow Creek Reserve, have severally been approved by I she Department. Skaatrn Besaae in Dakota-Chkogo, dlilraukee and 6aint Paul Bait. 1 way.-In the annual report of this office for 1880 mention was made of l a right of way granted to this oompany under the provisions of the treaty witti the Sissetou and Wahpetoll Indians, February 19,1867, for 1 $be extension of the Hastings and Dakota Division of its road west-warclly through the reserve. The compensation stipulated to be paid to the I~idiansw as at the rate uf $1.75 per acre for the lands required by the company for right of way and station purposes. A map of defi-nite loeation of the road was duly filed by the company and approved by the Department July 22,1880. The necessary papers evidencing the formal consent of the Indians were prepared and transmitted to the agent, hut pending the Indians' signature they were destroyed by 5re at the agency. In the mean time the company had projected another road, known as the Whetstone Branch of the Hastings and Dakota Division, running in a northwest~ar~lllldyi rection through the reservation, and whioh i t is understood is now partially built. Maps of definite location of the branch road hare been filed by the eonlpany with the Depart,ment, action upon which is deferred until the formal consent of the Indians ia obtained upon new papers whieh have been prepared and forwarded to the aggn~cy for signature. |
