Show __2__ day of June, 1952, and regularly continued from time to time, and evidence having been introduced by the parties hereto under and pursuant to the written stipulation of said parties dated the 4th day of September, 1952, and duly filed herein, and the Court having heard oral argument, and Points and Authorities having been presented and filed on behalf of said parties, and the matter having been submitted for decision, and the Court having duly considered said oral argument and said Points and Authorities, and being fully advised and satisfied in the premises, and having signed and filed herein its Findings of Fact and Conclusions of Law, and having directed that judgment be entered in accordance therewith, Now, Therefore, by reason of the law and findings aforesaid, It Is Hereby Ordered, Adjudged and Decreed: (1) That the contract between the United States of America and the Coachella Valley County Water District, dated December 22, 1947, and entitled, "Contract For Construction of Distribution System, Protective Works, and Drainage Works," a true copy of which (including Exhibit "A" thereof) is attached to the Complaint herein, is a valid and subsisting agreement of the parties. (2) That under the terms and provisions of said contract the plaintiff is obligated and is hereby ordered and directed to complete the work therein agreed to be performed by the plaintiff, and that the unfinished portion of said work be completed and finished at the earliest possible date, even though the total actual cost of doing and completing the work described in said contract requires expenditure by the United States of an amount in excess of $13,500,000. |
