Show not having been extinguished, ths matter is submitted to the Department, with the view of establishing definitely the jurisdiction of the Indian Office over lands similarly situated, not alone in Paneling the matters pertaining to the Round Valley Indian Reservation, •' but for the purpose of establishing a precedent for the future guidance of this Office, in cases of other reservo.tiohs -share the Indian title has not been extinguished by the purchase of 'the lands by the Government from the Indians and payment made therefor by, th. e G ov e m m en t.:' The act of October 1, 1890 (25 Stat. L. 553; provides for the survey wad allotment of the agricultural lands en this reservation; for the creation of gracing and timber reserves; and for the disposal of the remainder nat the proper land office of the United States, by the register thereof, at public sale", the proceeds to "be placed in the Treasury of the United States to the credit of said Indians." •"•;' The act of February 8, 1905 (33 Stat. Lo 706) provides that all the lands relinquished from this reservation under the act of October 1, 1390 (2S Stat. L. 658). shall':'be sur- ' veyed and re-appraised, and opened to settlement end entry under the provisions of the homestead laws of the United States; and that all the lends thus opened to settlement remaining undisposed of at the expiration of five years shall be disposed of for cash, the proceeds to be deposited in the Treasury cf the United States to the credit of the |
