Kimball of Parley's Park, County and State aforesaid, being first duly sworn deposes and says; that he 7/a_> a Lieutenant in one of the Companies of Militia of the Territory of Utah, ordered out by the Governor of said territory, in February 1849 or 1850, to protect the settlements of Utah County, Utah, against the Indians known as the "Utah Tribe", supposed to be under the leadership of an Indian by the marie of 7alksr; that said companies left Salt Lake City on tne 7th cay of February 1849 or 18bO, arrived at Provo the following morning, and found the Indians entrenched on the banks cf the Provo river; that said ..^.Indians were defeated after a seTere engagement and driven back to .v^the mountains, abandoning some of their women and children; that .
