Show Washington, D. C. Dear Mr. Commissioner: Reference is made to a letter submitted to your Office by Superintendent C. C. Wright of Fort Duchesne in which he transmitted a oopy of the resolutions agreed, to by the Utah and Colorado Utes with respect to the division of money that may be distributed to the various bands in the future. Por ready reference there is enclosed a copy of this resolution. It is our belief that the wording for division according to population should be inserted in any bill that may come to the attention of the Court of Claims or any other Jurisdictional Court so that the matter of the division of funds will not be overlooked in any legislation now being considered pending or future* The Southern Utes will be pleased if you will call the attention of Mr. Wilkinson, their Attorney, to the desire of all the Indians.. Settlement by ration of population is the only fair way in tho division of such proceeds. When the Court of Claims handed down the settlement for the oil shale lands for $161,400*00 it provided for the payment of two-thirds to the Utah Utds and only one-third to the Southern Utes; and unless proposed legislation is worded properly it is quite likely that th© Oov.rt of Claims will follow the wording of tvro-thirds to the Northern Utes and one-third to the Southern Utes which is not in line with the present resolution now before your Office.
