Show classification of fossil fuels and fuels derived from fossil fuels. Clean wood was also considered to be a fuel. Stakeholders disagreed as to whether biomass was considered to be a fuel or whether certain fuel-like materials could be classified as a fuel if they were within specified compositional limits. E P A staff has issued a draft definition of nonhazardous solid waste for purposes of guidance. The E P A draft definition included biomass as a fuel. De Minimus Levels Stakeholders hold different viewpoints on whether a combustion unit that burns a small amount of waste should be regulated under Section 129. The concept of D e Minimus has been used by E PA in regulating combustion of hazardous wastes. Size Thresholds For Section 112 regulated equipment, stakeholders did not agree on whether small units should be exempt from the regulatory process. For Section 129 regulated equipment, the C A A does not allow a minimum threshold MACT Floor The Maximum Achievable Control Technology ( M A C T ) floor for a category or subcategory is the least stringent regulation that can be promulgated for an existing source. The Coordinating Committee in general could not reach agreement on whether pollution prevention should be part of the M A C T floor for units regulated under Section 112 [2]. The emissions in the regulation "shall not be less stringent, and may be more stringent than - (A) The average emission limitation achieved by the best performing 12 percent of the existing sources (for which the Administrator has emission information), excluding those sources that have, within 18 months before the emission standard is proposed or within 30 months before such standard is promulgated, whichever is later, first achieved a level of emission rate or emission reduction which complies, or would comply if the source is not subject to such standard, with the lowest achievable emission rate (as defined by section 171) applicable to the source category and prevailing at the time, in the category or subcategory for categories and subcategories with 30 sources or more. (B) The average emission limitation achieved by the best performing 5 sources (for which the Administrator has or could reasonably obtain emissions information) in the category or subcategories with fewer than 30 sources. (4) Health Threshold - With respect to pollutants for which a health threshold has been established, the Administrator may consider such threshold level, with an ample margin of safety, when establishing emission standards under this subsection. (5) Alternative Standard for Area Sources - With respect only to categories and subcategories of area sources listed pursuant to subsection ( c ), the Administrator may, in lieu of the authorities provided in paragraph (2) and subsection (0, elect to promulgate standards or requirements applicable to sources in such categories or subcategories which provide for the C:\jps\ica\overviewa 5 |
