Show of him under this contract shall 'oa subject to the supervision and direction of tho Commissioner of Indian Affairs ana the Secretary of the Interior, and shall not make any compromise, settlement, or any adjustment of the matters in controversy, unless with the approval of either or both of the said officers; said attorney shall al3o pursue any litigation in question or which may be deemed necessary to and through the court of final resort unless authorised to terminate the proceedings at an intermediate stage of the proceedings; provided, however, that said attorney shall not abandon the suit or refuse to complete it unless so authorized by the Secretary of the Interior. In consideration of the services to be rendered under the terms of this contract, the party of the second part shall receive such compensation as .shall be determined by the Secretary of the Interior, to be paid from the amount of any judgment recovered and not to exceed J.O percent thereof, or in the case of a property rigrt established or settlement made through legislation or otherv/ise, then the amount and method of payment of such compensation to be determined by the Secretary of the Interior - The said attorney shall pay such court costs, witness fees, printing of briefs, and the like, as may be necessary In the proper prosecution of the case - such expenses to be no charge against "the parties of the first part unless hereafter authorized by Congress, and provided further, that said attorney shall not be'allowed any amount for travelling or personal expenses or for clerical.hire or otherwise* It is further agreed, that this contract shall continue for a period of five years, beginning v/ith the date of its approval by the Secretary of the Interior, provided that It may be extended for an additional period, of two years in the discretion of the Commissioner-of Indian Affairs, and such extension shall be effected by notice from him to the parties in Intoreat: It is also agreed that no assignment of this contract, or of any interest therein, shall be made without the consent, pre-viously: obtained,' from the Commissioner_,of Indian Affairs ana thia |
