Dear Sir:- Your letter of May 28th, relative to the canals belonging to the Dry Gulch Irrigation, and the Whiterocks Irrigation Complies, respectively, received, and-contents carefully noted. Y.ltli reference to your "request that proper action be taken to compel the companies to cease work, enjoining them not to make use of the canals already constructed until authorized by law or by the Secretary", will say that such an action cannot be brought by me without first obtaining instructions -from the Attorney-General. In a letter received by me on January 21, 1907, from the Attorney-General, the procedure in such matters is stated therein as follows: • ' "The Secretary of the Interior concurs in the recommendation "of the Commissioner of Indian Affairs as follow3:'The procedure, "no doubt, is for the agent ;to report such cases as he thinks "should be looked after by the District Attorney. If it appears "that the Agent is correct, the matter will be reported to tho "Department with a request that the Department of Justice direct "the District Attorney to appear in behalf of the Indians'. "Of course there may be cases when the time will not admit of "such a course. In that event, the Agent should appeal to the "Attorney direct and at the some time advise this office. "The Ar.ent will be instructed accordingly." I did not communicate this to you because I presumed that you had been instructed in that respect by the Secretary of the Interior, I do not quite understand why these companies havo boon permitted to do so much work on the canal3 without the matter laivinn been reported. v |
