Sir:- ' Replying to office letter narked as above dated Washington, D. C,October 28,1805,1 havo the honor to submit that iny action as alleged by Mr. II. Without doubt Mr. Lake is the original locator" upon the claim from which tho Asphaltum ho seeks to recover "van mined. I know nothing of the deal he was making with the conrp-ray at 3alt Lake City that was engaged witli hin in removing this stuff from its bed, Go far as I can learn no one other than Lake can havo any sort of right to ask for the Asphaltum in question. Inasmuch as no acknowledgment was ever made by the Department of the receipt of my report of February 23th, 1804,1 do not deer, it prudent in my own personal interest to recommend that this ore be given to Mr. Lake by the Department,but as the Government has no use for it, and as Lake states in his letter it is constantly deteriorating in quantity and value,and as Lake is an old man and in reduced circumstances if the Dcparymor.t authorizes me to do so, I shall |
