Commissioner of Indian Affairs, Sir:- I 'acknowledge the receipt of your communication of 14th ultimo, in reply to letter from Mr. N. Lake, of Fort Duchesno, Utah, relative to certain Asphaltum mined by him on the Uintah or Ouray Indian reservation, Utah. Mr. Lake states that not knowing precisely where the Indian reservation lines were, he trespassed thereon; that he was promptly elected from the reservation by the Agent and the ore was confiscated. He now asks to be permitted to take the ore and realize what he can from it. Acting Agent, Major Randlett, states that Lake is an old man in reduced circumstances, and that he will, if the Department authorizes it, be pleased to permit him to remove what remains of the asphaltum, and you recommend that the Agent be authorized to permit him to remove the same, with a caution to carefully avoid trespassing on the reservation in future. As this ore is the property of the Indians if on the Uintah reservation, I know of no authority conferred upon the Department to grant tho roquost made by Mr'. Lake.
