Show rents or royalties only to such person or persons as the. Secretary may direct in accordance with such notice, for the use and benefit o£ the partjr of the first part; that -fae- will not recognize any transfer or assignment of said rents and royalties made by said part*? of the first part without the approval of said Secretary of the Interior, and will pay the yi*> same only to the partjt oi' the first part in proper person,or on such approved assignment. And said party of the second part for hi i v) r i f- *-"-"" executors administrators, and assigns, covenants and agrees that this indenture is made with the express proviso that if any of said rents and royalties shall remain unpaid for thirt days after the same shall have become payable as aforesaid, or if the said part" of the second part shall, in violation of this indenture and without the consent of the said Secretary of the Interior, assign this lease or underlet or otherwise dispose of the whole or any part of said leased premises or use the same for any purpose save that hereinbefore author ized and agreed upon, or shall commit waste or suffer it to be committed on said premises,' or misuse or fail to take proper care of the same, or shall nay or surrender said rents and royalties to any person other than the said part. 4^0 f the first part, as above set forth., or shall fail to exercise due diligence in prosecuting said prospecting and mining operations to the fullest practicable extent on said land and in a workmanlike manner, or shall fail to keep and perform all other agreements and covenants contained in this indenture then or in either of such contingencies, this lease shall X" |
