S i r : --- * I have the honor to forward herewith report of Lieut. Kurnett, 9th Cavy., r e f e r r i n g to detached s e r v i c e performed under i n s t r u c t i o n s of Col- Edward Hatch, Oth Cavy., my predecessor in command of t h i s post- In order that the Department Commander may have before him as f u l l information as p o s s i b l e in the m a t t e r , I s o l i c i t e d a copy of report made by Mr. McKewers, who r e p r e s e n t ed the I n d i a n Dept. in t h i s s e r v i c e ; please find same enclosed- Col. Byrnes informs me t h a t he has forwarded Mr- McKowen's report to his Chief at Washington v/i thout - remark, deeming the report e x p l i c i t and covering the e n t i r e ground. It anpsars almost, c e r t a i n that Colorow and a l l the Indians r e f e r r e d to in these r e p o r t s are off the reserv a t i o n . I have v i s i t e d Col. Byrnes at the Agency, who p o l i t e ly allowed me to go over the records of hit; o f f i c e , wherein I found a communication under date of October 1885, from the }loa. Oommiss ion-er of Indian A f f a i r s , s e t t i n g f o r t h that i t was by him understood that Colorow was with .his followers, on Douglas Creek, off the r e s e r v a t i o n l i n e , and informing the Agent that Indians were allowed under p r o v i s i o n s of law, to homestead and preempt public lands,and •'pp/isY!.; that this Chief b;! a s s i s t e d in h i s purpose to make his hone in that l o c a l i t y , by conforming to legal requiremen t s in the c.ise. It appears that Colorow was informed accordingly, .and was promised that he would r e c e i v e support in h i s claims, should it prove that he was on. public domain.
