Sir: In taking step3 necessary for the safe guarding of the water rights of the Indians of the Uintah Reservation, Utah, it is advisable to canvass the possibilities of all moves which may in the future have to be made towards effecting the desired result. In this connection I should liKe to be advised at an je^^-i^M^^B^^^Maj^^^^^fy eminent domain f oi^canala^etc., can be exercised by any person or corporation over Indian allotments not yet patented, or will it be necessary for the said person or corporation tc first obtain the consent of the Government, as in the case of canals traversing Forest Reserves and Indian Reservations. The situation which calls forth thi3 question is as follows: There are some forty thousand acres of land to be allotted on the Uintah Reservation along and embracing the Uintah River and its chief tributary, the Whiteroclcs River, for a distance of about twenty-four miles.
