Tho Secretary of the Interior, Washington, D. C. Sir: In a report dated October 8, 1907, with respect to a proposition submitted to the Department by the Uintah River Irrigation Company, Utah, which was subsequently referred to me, and disapproved for reasons stated, I made the following suggestions, viz: " A fair compromise which., in my opinion, the Department could consider if submitted in this case, would be as follows- viz: Withdraw the suit against the Uinta River Irrigation Company, and grant it full permit to cross the grazing reservo for the purpose of constructing its independent canal from Whiterocks Creek, in consideration of an agreement on the part of said Company whereby it would concedo to the Indians the prior right to the 25 second feet of water now claimed, for a period of five yearc from the date of the approval of its application by the State Engineer. Should the Depart/nent then fall to make beneficial use of the water in the period named, which is the maximum time allowed oy the State Engineer, and be unable to perfect the right, the came should revert to the Uinta River Irrigation Company, providing it had canals constructed, and a sufficient area of land farmed, to make proper final proof on • the said 25 second feet. This is substantially what tho Government, on behalf of the Indiana, has requested of the State Engineer, as against all would-be appropriator3 of the waters of the former Uinta Reservation, viz: that the Indians be given priority No. 1, and the maximum time of five years to perfect the filings. The State engineer has granted the Indians such priority in every instance aside from the one heroin discussed, and if the Uinta River Irrigation Company want to enter into a contract which 13 fair to the Uteo it could very properly consider one based upon euch terms a3 above suggested.
