Uintah River Irrigation Co. requesting information. The Commissioner of Indian Affairs, Washington, D. C. Sir: Referring to your letter of the October 19, 1907, Field Work, 83490-1907, relative to the counter proposition to be submitted to the Uintah River Irrigation Co. for the purpose of settling the existing differences between, this Company and the Government, I desire to inform you that I urn in receipt of a letter from Mr. Sims, the President of this Company, in which certain pertinent questions are submitted for answer. These questions are forwarded to your office for ouoh explanation to the Company as may be. desired. The points to be considered are a3 follows: Firat:"l8 it proposed to transfer or lease any of the water rights subsequent Lo the twenty five second feet to our company during the five years? If not I do not understand how our oompany could perfect a water right which it did not have, or how it could farm a sufficient area of land, or any area whatever, without any water righto." Second:"Is it proposed that we shall transfer our Company's rights to the twenty five second feet of water to the Indi-ns, provided at the end of five years they have made a beneficial use' of the water for that period9" Third:"What is proposed in the event that the Indiana should use only a portion of the twenty five feet during the five year period? Would tho part of which they did not make beneficial use be transferred to our company at the end of the five year i.'.riod?" Fourth:"lo it intended that the Department shall have the right during the five year period to lease the twenty fi«-e second foot or any part thcroof, to persons other than the Indians, or is it intended that if the Indians themselves do not use tho water that it shall revert to our Company at the end of the five year period?"
