Memorandum to the Solicitor; The Uintah Reservation in the State of Utah was k- established pursuant to agreement with certain confederated bands of Ute Indians then residing on a reservation in the State of Colorado. Thi3 agreement with certain modifications was accepted and ratified by act of June 15, 1880 (21 Stat. 199), and the Uintah and Ouray bands removed to the Uintah Reservation. However, the "enabling act for the State of Utah, July IS, 1894, provided that the peonle thereof should forever disclaim all right and title "to all lands lying within said liaaias owned or held by any Indian or Indian Tribes; and that until the title thereto saall have been extinguished by the R United States the same shall be and remain subject to ~ the di3oosition of the United States and 3aid Indian land3 shall remain under the absolute .jurisdiction and a. control of the Congress of the United States.M Further, - by ths Constitution of the Stabe of Utah the oeople of t that 3tate affirmed and. declared that they forever disclaimed all right and title :lto all lands lying within said limits owned or held by any Indian or indian Tribes and that until the title thereto shall have been extinguished by the United States the saaie shall be and remain subject to the disposition of the United States and said Indian lands shall remain under the absolute jurisdiction and control of the Congress of the United States. !l It is observed here, also, that section 4 of said act of June 15, 1330, subjected the Indiana uoon said reservations to the provisions of section 1977 of the Revised Statutes and the Laws, both civil and criminal, of the State or Territory in which taey might reside only "upon the completion of said allotments and the patenting of the lands to said allottees".
