Show DEPARTMENT OF THE INTERIOR UNITED STATES INDIAN SERVICE Uintah & Ouray Indian Agency, "Port Duchesne, Utah, September 29, 1^13• Cojinisnioneivof Indian Affairs, Port Duohesre, Utah, Dear £ir:~ I am enclosing herewith two blank forms of acceptance of service of eT.ry.oons to appear in a suit involving the condemnation of the right of way by the Ouray Valley Irrigation Co, The letters of transmittal of these forme are alno enclosed for the information of the Office as to the opinion of the attorneys sending them. The forms came to thin office while I was away and the matter has not been attended to, I do not believe the Court which is attempting to .handle thin matter has -Jurisdiction at all, .They are seeking the right of way for a ditoh, a portion of which crosses the ln«Uan gracing ground, I do not believe it is their province, and it is certainly not in accordance with any instructions which we have received regarding rights of way across those lends. The matter was instituted long before I oame to this Reservation and I am not entirely familiar with it, but I believe the water from the stream out of which the proposed ditch would be supplied will be all taken up In irrigating the Didlan Lands, and I do not favcr the rrarting of this right |
