The Commissioner of Indian Affairs. * J' ft >' 0 Sir: In your letter of June 3, 1911, it is stated that tha Acting Indian Agent in charge of tha Uinta Ouray Agency, Utah under date of llarch 20, 1911, had asked whether "an allotment made for that reservation ia contestable on the ground that it 13 known to contain mineral." It appears that tha specific allotment referred to (Uo.525)of Ackista Jenkins, or Ac-Kists, an Indian of the Uncora- -pahgre Ute tribe, covering the S.£ im.i and W.-J- SW.£, Sec. 22, T. 10 S., R. 20 S., S. L. M., was approved by the Department July 7t 1905, and that on August 2, 1905, the first or trust patent issued therefor. It is reported that said land "contains a vein of gilsonite." It appears, as is stated ay your office, that this allotment wa3 made under the authority of the acts of August 15, 1394 (28 Stat., 286, 337), and June 7, 1897 (30 Stat., 62, 87), and that the trust patent was issued |
