It is allogod with detail that all of the waters of tho river are necessary for all thoso purposos and the pur-poros for Vhioh tho reservation was created, and that in furthering and advancing tho civilization and improvement of the Indians, and to oncourago habits of industry and thrift among them, it is essential and necessary that all of the waters of the river flow down the channel uninterruptedly and undiminished in quantity and undctoriatcd in quality. It is allogod that "notwithstanding tho riparian and othor rights" of tho Unitod fltatoo and tho Indians to tho uninterrupted flow of tho wators of the rivor. the defendants, in tho yoar 1900, wrongfully ontorod upon tho rivor and its tributaries above tho points of tho divoreion of the. waters of tho river by tho United States and the Indians, built largo and substantial dams and roscrvoirs, and by means of canals and ditches and waterways have divortod the wators of tho rivor from its channel, and havo deprivod tho Unitted States and tho |
