A V Prom a detailed report made to tho Attorney General'"'4-^ J. by Examiner Hornbeak of the Department of Justice, September 9, 1908, a copy of which was transmitted to this Department, it appears that on August 15, 1907, a suit in ejectment was instituted in the United States Circuit Court for the District of Utah by the United States of America, a3 trustee and guardian for Jack Antoina and other Indian allottees, against the Pry Gulch Irrigation Company, a corporation, Civil No. 951, • The last action noted on Examiner Hornbeak's report was an order dated January 23, 1908, overruling the demurrer and allowing thirty days within which to answer. The local Unitod States Attorney 3tates that this action is brought •to eject the defendant company, a trespasser upon Indian allotments; that the defendant is in default and has left tha lands affected; that the object of the suit was to force the defendant to proceed to properly acquire a right of way before entry upon allotments, and that such action has been taken by the defendant. He advises that the case be permitted to rest until the action above referred to has been completed. |
