Show United States, reserving nevertheless to the said Secretary of tho Interior of tho United States, all rights ho, and those he represents, have- in and to tho said canal, and tho full water carrying capacity of said oanal as abnvo stated, and as contained within tho caid canal as now constructed. 7th. It is further considered, adjudged and decreed that tho plaintiff at any time after the first day of October 1908, and bo-fore the first day of April, 1909, and within the sane datis of tho year 1909 and 1910, or at any time when oonsentod to by the defendants, and said oanal is not used for convoying water, may, and it is hereby authorized to enter on to thelond above dnscribod and condemned for canal purposes, and ontor into tho oannl thereon constructed and enlarge the same to the following dimensions, to-wit; - - "Conal No. 1", to a width of 22 foot on the present bottom and grade of tho said canal, and maintaining the lower bank of tho said oanal at not less than 4 foot above tho bottom of tho canal, and any and all portions of the said canal containing flumes, pipes, or other construction than earth and rock, shall in such enlargement bo constructed in manner and size to conform to plans and specifications for suoh constructions to bo furnishod thorefdr by Capt'. C. G. Hall, Acting Indian Agent-; of Whiterocks, Ut^h, or his successor 'and tho said plaintiff shall in the onlarger'u-nt of the said canal, as herein authorized, complete tho same in good substantia.! 8nd finishod state so thoy will conform in efficiency, margin of safety and completeness with the plan of the original construction of said canal. 8th. It is further ordered, adjudged and decreed that any and all gates, dans and means for lotting water into the said canal, and all dividing gates, woirs, dams, devices and oponingn of every kind for drawing water into or out of tho said canal, and dividing tho same, which may require romoval in said enlargement, and all suoh constructions of weiry nature necessary t o bo plaood in said canal |
