Show 384 -3- The Corraiesicnsr of Indian Affairs is authorized and required, with the approval of the Secretary of the Interior, to remove from any tribal reservation any person being therein without authority of law. or whose presence within the limits of the reservation may, in tne judgment of the Commissioner, be detrimental to the peace and welfare of the Indians, and may employ for the purpose such force as may be necessary to . enable the agent to effect the removal of such person. If, therefore, Llr. Pike's presence on the reservation is detrimental to its peace and wlfare, there is no question but that he may be removed under the provisions of this section. To accomplish that end, the facts should be reported to this offioe and authority requested from the Secretary of the Interior. As to 2ir. Pike's rights to the property accumulated on the reservation, including money which may be deposited in his name,and which represent the profits of his undertakings on Mrs. Pike's land, the office has to say that as to the buildings and other improvements on the lands, these unquestionably belong to Mrs. Pike and her family and will be secured to her and them by allotment at the proper time. As to the personal property, the office feels that Mrs. Pike and her family should be fully protected in their possession of the horses, cattle, farming implements, etc., which they have at their home. It is not thought that civil processes will run on the reservation so far as the lccal courts are concemod, so that any efforts which Mr. Pike may make to secure such property should be resisted, at least until the matter is properly tested by the courts, if the same should be prosecuted to that extHnt. |
