Show Work to Be Performed 35. Kennecott shall perform the actions required by the attached Work Plan, including the following: a. Provide transportation, and disposal in the Bluewater Main I Repository, of no more than 60,000 cubic yards of lead and arsenic contaminated soils, containing only limited amounts of coarse organic material and excluding organic chemical or hydrocarbon contamination, removed by EPA, from Phase I Herriman Soils Removal Action Area; b. Provide no more than 60,000 cubic yards of clean backfill to replace soils removed from residential yards of the Phase I Herriman Soils Removal Action Area. Work Plans and Implementation Work Plan The Work Plan shall provide a description of, and an expeditious schedule for, the actions required by this Order. The Work Plan, as approved by EPA after notice 36. and opportunity to comment by the State, is hereby incorporated by reference into this Order as Exhibit 2. 37. The Work Plan includes a Sampling and Analysis Plan, a Health and Safety Plan and a Quality Assurance Project Plan. The Health and Safety Plan shall be in accordance with the Occupational Health Hazardous Waste Operations and Emergency Response rule set forth in 29 C.F.R. Part 1910. Quality Assurance and Sampling 38. Kennecott shall assure that all sampling and analyses performed pursuant to this Order shall conform to EPA direction, approval and guidance regarding sampling, quality assurance/quality control (QAlQC), data validation, chain of custody procedures, the requirements of this Order and the approved Sampling and Analysis Plan. Kennecott shall ensure that any laboratories used to perform analyses participate in a QAlQC program that complies with relevant EPA guidance. Upon request by EPA, Kennecott shall have the laboratory it uses analyze samples submitted by EPA for quality-assurance monitoring. Kennecott shall provide EPA with copies of the QAlQC procedures followed by all sampling teams and laboratories performing data collection or analysis if such procedures differ from the approved Sampling and Analysis Plan of Quality Assurance Project Plan. Kennecott shall allow EPA or its authorized representatives to take split samples of any samples collected by Kennecott while performing work under this Order. Kennecott shall notify EPA not less than two days in advance of any sample collection activity. EPA shall have the right to take any additional samples that it deems necessary. 9 |
