Chief engineer W.H. Code inquires about the rights of canal-builders to access lands allotted to Indians. Code attempts to protect water rights for Indians looking to create homesteads on reservation lands. The U.S. Attorney General responds to the correspondence; he claims that, under Utah law, that crossing private lands for the purpose of irrigating ditches is a circumstance in which the laws of eminent domain may be applied |
