Dear Captain:- /\ Your letter/of May 17th duly received, and I was glad to hear from you andv^_» obtain your views with reference to the water rights of the Ute Indians. The deoisiori whioh you inquire about is known as the United States va. Winters, et al, regarding the rights to the waters of Milk River, on the Fort Belknap Reservation. I think this decision oould hardly be applicable to the Former Uintah Reservation, especially since the appropriations undor which we constructed the irrigation systems on the Formor Uintah Reservation provide that the work is to be performed in accordance with the State laws of Utah. You oan obtain a copy of the opinion, however, by addressing a letter to the Indian Offioe. I agree with you that it is tho duty of tho Government to protect to the utmost the water rights of its wards, but it is a question a3 to Just how rouoh a State or the individual settlers should have to subsoribo towards the preservation of such water rights. When the State has given the Indians the maximum timo in whioh to make good, in aooord-anoe with its irrigation code, and the Government, as tho |
