As per i our A'--..est I i • 11 you to-day, under separn.t.0 cover, the T.'TI,; which ;you .-.< -it rx- i.'ho'.ving the location of 7"T,e canals, so that you may ascertain the nr^ou of Indian allottees affected by the construction of these omnia, I desire to do everything possible to aid you in protecting the rights of the Indiana in these matters but, aa heretofore stated, I have no authority to bring an action of this character without the consent and approval Of the Attorney-General• It is my opinion that the Dres.c'cn. and tho Dirt-otoru. of these irrigation companies cannot proceed with 'cue construction of these canals without first having cbniplied with the requirements of the law. Actions to condemn rights-of-way should be commenced by these companies in the State courts and a proper bond given.
