Show TO THE FOLLOWING: COMMISSIONER OF INDIAN AFFAIRS UNITED STATES DEPARTMENT OF THE INTERIOR OFFICE OF INDIAN AFFAIRS WASHINGTON Mr. Edward E. McKean, Supt., Consolidated Ute Agency. My dear Mr. McKean: The Office is in receipt, by reference from Special Allotting Agent Simington, of a letter from Herbert Redshaw, farmer under the jurisdiction of the San Juan Agency, reporting on some trouble between a Navajo by the name of Whitehorse and a Paiute by the name of Mike over the use of a spring on Douglas Mesa, Utah, in townships 41 and 42 South, Ranges 16 and 17 East, S. L. M. Mr. Simington reports that he made allotments to the Mike family of certain lands on which two springs were located and to the Whitehorse family of certain lands containing several springs. The Paiutes of this section are under your jurisdiction, while the Navajos are under the jurisdiction of the Western Navajo Agency. In order to avoid serious trouble in the above locality you are requested to get into communication with Harvey K. Meyer, Superintendent of the Western Navajo Agency, immediately upon receipt of this letter and set an early date upon which you can both visit the land under dispute and finally settle the matter. The lands allotted by Mr. Simington to the Indians on Douglas Mesa are their individual properties and Navajos have no right to interfere with Paiutes in the peaceable enjoyment thereof, neither have Paiutes any right to interfere in the use and occupancy by Navajos of their individual lands. After action has been taken as suggested by this letter, you are requested to submit a full report to the Office. A copy of a letter of even date to the Western Navajo Agency is being inclosed here with, and copies of this letter are being furnished Mr. Simington and the Superintendent of San Juan Agency. Very truly yours, E.B. Meritt Assistant Commissioner |
