Show 2 is not U3ed for any purpoce whatever on the Indian reservation; that the land in question,both on and off the reservation, is unsurveyed,and for this reason you are unablo to file a map aa provided in section 19 of the Act referred to; that you have already expended a large si*n of money in the construction of a reservoir and ditch for the purpose indicated; that it would be a severe loss for you should you not bo permitted to continug the uso of tho said oanal and reoer/oir,o3 you jiro without the necessary means to take the water out at a point above the Indian reservation; and that tc go around the reservation would require the construction of a canal over tsn n-iles in length and through a rough,broken country. You state,al3o,that United States Indian Agent Waugh of the Uintah Agency has called upon you for the authority under which you are constructing the said reservoir and ditch; that he concedes that no possible damage can arise frcm your use of the water,as you only save the same which would otherwise go to waate, and which is never used by the Indians, You ask whether under the said Act you have the legal right of way for your reservoir and car.al over the Indian reservation* |
