UTAH 8-<: 101 TELEPHONE 801/533-5755 Dear Mr Ward: Shortly after completion of the review meetings and comment deadlines for consideration of the nomination of those buildings in Beaver which appear eligible for listing in the National Register of Historic places, Congress passed ammendments to the National Historic Preservation Act of 1966. One of the ammendments formalized a procedure that had already been in effect here in Utah--providing the owners of properties under consideration for nomination to the National Register of Historic Places, the opportunity to object to the listing. Your property, at 195 East 300 South and about 180 East 300 South (rear), has been recommended for nomination. If listed in the National Register of Historic Places there are no restrictions placed on you as a property owner. You are still able to sell, renovate, demolish or alter your property just the same as if it were not listed in the National Register. The purpose of the listing is to document and identify those buildings, houses and sites and structures, which help us understand the past history and development of communities, the state, or the ' nation. There are some tax benefits for rehabilitation work on commercial buildings and one tax penalty if you demolish a listed building. The tax penalty is that you are not able to write off as an allowable expense the demolition costs. If you wish to object to the listing of your property in the National Register you must submit to us a notarized statement that you are the owner of the property and that you object to its listing in the National Register of Historic Places. The notarized letter will insure that your property will not be listed in the Register and only a determination of the property's eligibility for the National Register will be made. The notarized statement objecting to the nomination must be submitted before May 1st of this year at which time the nomination will be forwarded to the National Register Office for final action. We would also appreciate any letters in support of the nomination of your property. I will be in Beaver on Tuesday March 16th at the Beaver County Courthouse in the Commision Chambers from 2:00 p.m. to 5:00 p.m. and 7:00 p.m. to 9:00 p.m. to answer any questions about the nomination and any other questions you may have. The publication on Beaver will include an historical overview, section on Beaver's architectural history, and a photograph and short history of each of the historic buildings in the community. I am enclosing a copy of the structure/site information form which will be used in preparing the history of your property. I will have a copy of the Avenues book with me so that you can see the format for the Beaver publication which we hope to have out the end of thi s year or early in 1983. Statement of Historical Significance: Construction Date: cr: The log cabin is important 'because it is one of the few such structures still ,extant in Beaver today . J: Mr. Karl Ward explained that he was born in the log house in 1907 and that the family moved shortly thereafter to the newly completed brick house on the same property. The log house was built before 1900, Mr. Ward says, and this researcher believes it could have been as early as the late 18608. The gables are infilled with milled siding which therefore probably precludes the 1850s era. ....oCIl The ~abin originally sat on the corner of the lot, but was moved northwestward to its present location to make room for the 1907 brick house. Ward 175 East 300 South Beaver, UT 84713 Dear Mr. Ward: It is my distinct pleasure to inform you that on September 9, 1982 the Charles Willden House at 180 East 300 South, nominated by the Historic and Cultural Sites Review Committee and the Utah State Historic Preservation Officer, was officially listed on the National Register of Historic Places by the National Park Service and Ms. Carol Shull, Acting Keeper of the National Register. The National Register of Historic places is the official list of historic properties recognized by the Federal Government as worthy of preservation for their significance in American history, architecture, archeology, engineering and culture. Located in the National Park Service, Department of the Interior, the program is part of a national policy to coordinate and support public and private efforts to identify, evaluate, and protect our cultural and natural resources, and is maintained by the Secretary of the Interior under provisions of the National Historic Preservation Act of 1966. Listing in the National Register provides the following benefits to historic properties~ -Consideration in the planning for federally assisted projects. Section 106 of the National Historic Preservation Act of 1966 provides that the Advisory Council on Historic Preservation be given an opportunity to comment on projects affecting such properties. -Eligibility for Federal tax benefits for rehabilitations of certain historic commercial, industrial and residential rental buildings. -Consideration of historic values in the decision to issue a surface coal mining permit where coal is located, in accord with the Surface Mining and Control Act of 1977. Listing does not mean that the Federal Government wants to acquire the property, place restrictive convenants on the land, or dictate the color or materials used on individual buildings. State and local ordinances or laws establishing restrictive loning, special design review committees, or review of exterior alterations, are not a part of the National Register program and should be clearly separated from the function of the National Register as a tool in the Federal planning process. The log house was built before 1900, Mr. Ward says, and this researcher believes it could have been as early as the late l860s. The gables are infilled with milled siding which therefore probably precludes the l850s era. Listing in the National Register of Historic Places does not place restrictions on the property or mean that the federal government wants to acquire the building or site. Any restrictions which may be placed on a property are the result of local zoning ordinances and not the National Register Program. It contains the name of the site, the nature of its significanc\; , the date of listing, and the signatures of Governor Matheson, Milton Abrams, Chairman of the Historic and Cultural Sites Review Committee, and Melvin T. Smith, Director of the Utah State Historical Society and Utah's State Historic Preservation Officer. There is no charge.
