Description Living will statutes have been a recent attempt in many states to respond to amazing technological advances in the world of medicine which have made possible the continued survival of many patients and the postponement of death. However, not all patients desire these medical advances. Competent adults can exercise their capacity for decision-making by merely not seeking, or declining, any medical treatment, including life-sustaining treatments. Unfortunately, incompetent or incapacitated patients often have to rely on decisions made by family members, friends, or health care providers. These decisions oftentimes are not decisions which the patients themselves would have made.
