The remaining 3740 with accrued'interest should, in my opinion, revert to tho tribe; and tho allottee should then be allowed to 0,elect an allotment on irrigable land on any of tho areas now subject to allotment to these Indians. This would, in my opinion, bo a fair compensation to the allotteo and a .just disposition of tho proceeds. I beliove that upon instructions from tho Offico as to the disposition of the proceeds of tho sale, 'this allottc may be induced to cooperate in whatevor plan is suggestod. Purthormore, it is my opinion that the price now offered by the irrigation company is ample to cover the value of the land upon which trespass was committod by them. In-as-much as the salo is to be negotiated on tho deferred payment 'plan, the question has arisen whether it would not be better to write,up the salo on tho usual blanks, havinp the memorandum of sale and the notes calling for tho deferred payments oxocutod in the usual manner, patent in foo |
