Bear Sir: It is probably unnecessary for me to call your attention to the fact that many vested rights have accrued and also many rights have been initiated previous- to the enactment of the "irrigation code of 1903? The. fact of the construction of irrigation ditches and the beneficial use of water through those ditches upon definite areas of land, would constitute suffi-to any rights inaugurated since the statute of 1903 became effective. I do not therefor deem it necessary (except as you may deem it profitable simply as a matter of record) for you to file applications that have reference to the beneficial use of water that has resulted from constructions that were begun prior to 1903. Of course in the matter of new works or in the matter of modification of old works, the application forms and the lawful procedure should be used. I am sending you under separate cover, twenty blank applications and a copy of the 1903 irrigation code, which with a few minor amendments is the present law. As soon as the pres- |
