Title |
Equal protection of the laws: an evolving doctrine |
Date |
1989 |
Description |
A simple sounding command of the Fourteenth Amendment sets forth that no state shall "deny to any person within its jurisdiction the equal protection of the laws. "1 This cannot mean that laws must deal in the same way with each person, since almost all laws classify, by imposing some burdens or granting some benefits to some, while not to others. If by its nature, legislation classifies, what content can be given to this guarantee of equal protection of the laws? |
