Show 4695 Kirkpatrick- C 2709 have a right to probe this witness. I will say I have reason to believe that his recollection is some what cloudy. I am about through, through. I think I am within the proper limits with this witness. MR. BLACKMAR: I still insist on my objection that it is argumentative. THE SPECIAL MASTER: I don't think it is necessary to go over why the witness testified before in this hearing. I think now we have reached a stage where that must be left to the court to decide. FARNSWORTH: Q Calling your attention now, Mr. Kirkpatrick, to this trip you took on the Colorado between Moab and Lockhart in 1926, the first trip on the Colorado that you describe in your direct examination, you stated in response to questions put by counsel, as I recall your testimony, that when you came back up the river the next day you noted that the channel had shifted at various places; is that correct? A I believe it is, yes. Q And when you came back up the river the next day you observed that the deep parts of the river were over in some other place than they had been the day before, is that right? A I believe that in right. Q Been a complete change in the channels of the river as they extended through that territory? |
